By law, Montana’s Lottery Commission consists of five members appointed by the governor. One of the five must have five years experience as a law enforcement officer, one must be an attorney and one must be a certified public accountant. The commission oversees the Lottery’s operations, sets policy and determines the type and forms of Lottery products. The governor also appoints a director who administers the day-to-day operation of the Lottery.
Each commissioner is appointed to a four-year term and the terms are staggered. Current commissioners are:
Three or more commissioners constitute a quorum to do business and action may be taken by a majority of a quorum.
Montana Lottery is governed by Montana law and the Administrative Rules of Montana. The laws that govern the Montana Lottery are found in the Montana Code Annotated, Section 23-7-101 to 23-7-412.
Administrative Rules are state agency regulations that define policies or implement certain state laws. New rules can only be created by following set policies. The Montana Secretary of State oversees the publication of the Administrative Rules of Montana.
